Terms of Service

1. The SetPlan Service
SetPlan is a focused workout-programming tool for fitness professionals and personal trainers. It allows trainers to assemble, duplicate, and publish workout programs and deliver them via mobile web links. By creating an account or using SetPlan, you agree to these Terms.
2. Trainer Professional Responsibility
The trainer is solely responsible for the content, exercise selection, volume, instructions, and physical suitability of all workout programs they create and share. Trainers must ensure their recommendations comply with applicable professional standards, industry certifications, and the health status of their individual clients.
3. No Medical Advice
SetPlan is a software tool, not a health care provider. SetPlan does not provide medical advice, diagnosis, or treatment. Physical exercise involves inherent risks of injury. Workouts should only be undertaken by individuals who are physically qualified and have received appropriate medical clearance where necessary.
4. Program Publishing, Credits & Lifecycles
First 2 Programs Free: New trainer accounts receive 2 free program credits, enough to publish their first 2 programs free of charge. No credit card is required to use them.
What Uses a Credit: Publishing a new program uses 1 credit. This includes publishing a replacement program for a client who already has one. Creating and editing drafts does not use credits. Deleting a client or a program does not return a credit that was already used to publish.
Non-Expiring Credits: Purchased program credits do not expire. Credits remain available in your account until redeemed to publish a new program.
30-Day Trainer Editing Window: Once published, a program can be modified and updated by the trainer for 30 calendar days. During this window, edits appear on the live client link and do not use another credit.
Unlimited: While an Unlimited subscription is active, publishing a new program does not use a credit, and your credit balance is kept for later use. When Unlimited ends, programs already published are not affected.
Continued Client Access: A client link stays active for as long as the client remains in the trainer’s list, including after the 30-day editing window closes; while it is active, clients can view their exercises and record working weights. If the trainer removes a client from their list, that client’s link stays active for 90 days from the removal and then stops working. If the trainer deletes their account, their client links stop working immediately.
5. Payments and Merchant of Record
Program credits are sold individually and in bundles, and Unlimited is an optional monthly subscription that renews each month until cancelled. You can cancel it through Manage Billing in your SetPlan account; cancellation takes effect at the end of the current billing period. Paddle.com Market Ltd ("Paddle") is the Merchant of Record for all SetPlan purchases.
This means Paddle processes payments, handles billing and applicable sales tax or VAT, and appears on your receipt and card statement. Refunds and payment disputes are handled in accordance with our Refund & Cancellation Policy, Paddle’s buyer terms, and applicable law. Prices and credit options are displayed before purchase, and the amount shown at checkout is the amount charged.
6. Acceptable Use
You agree to use SetPlan only for lawful purposes. You must not: upload infringing, harmful, or abusive material; attempt to circumvent system limits or access unauthorized accounts; or disrupt, reverse engineer, or compromise the stability and security of the platform.
7. Account Suspension & Abuse
We reserve the right to suspend or terminate accounts that engage in abusive behavior, system exploitation, fraudulent activity, or violations of these Terms.
8. Intellectual Property
SetPlan retains all rights, title, and interest in and to the platform, including software, interface designs, trademarks, exercise library content, and SetPlan’s own logos. Trainers retain ownership of the original text and custom notes they author, and of any logo they upload. A trainer who uploads a logo permits SetPlan to store it, resize, trim and re-save it, and display it on that trainer’s client program links and PDFs and in the trainer’s own account, solely to provide that feature. This permission ends when the trainer removes or replaces the logo or deletes their account, apart from the short period needed to delete the file, as described in the Privacy Policy.
9. Service Availability & Modifications
SetPlan is provided on an "as is" and "as available" basis. We strive for consistent uptime but do not guarantee uninterrupted availability. We may modify or update features to improve service quality.
10. Limitation of Liability
To the maximum extent permitted by applicable law, SetPlan and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for injuries resulting from physical exercise programs. In all events, SetPlan’s aggregate liability shall not exceed the amounts paid by the trainer to SetPlan in the twelve (12) months preceding the claim.
11. Termination
Trainers may discontinue use of SetPlan at any time. Stopping use of SetPlan does not by itself cancel an Unlimited subscription; cancel it through Manage Billing.
Trainers may delete their account at any time, in the app (Account → Delete account) or by asking us as described in our Privacy Policy. Deletion is immediate and cannot be undone. When an account is deleted: an active Unlimited subscription is cancelled immediately, so no further payments are taken; the rest of the current billing period is not refunded automatically; unused credits are removed with the account and are not refunded automatically; and the trainer’s client links stop working. Provisions regarding intellectual property, warranty disclaimers, liability limitations, and professional responsibility shall survive termination.
